Indiana Telephone Network – Terms of Service.

Effective Date: January 14, 2026

These Terms & Conditions (“Terms”) govern the provision of telecommunications services by Indiana Telephone Network (“ITN,” “Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). These Terms apply to both business and residential customers, unless otherwise expressly stated in writing.

By ordering, activating, or using ITN services, Customer agrees to be bound by these Terms. If Customer does not agree, Customer must not use the Services.

  1. Services Provided

ITN provides telecommunications and related communications services, including but not limited to hosted VoIP and Virtual PBX services, SIP trunking, local and long-distance calling, voicemail, conferencing, and related features and services (collectively, the “Services”). Services may be provided on a recurring, non-recurring, usage-based, contract, or other basis as determined by ITN.

ITN reserves the right to modify, suspend, or discontinue any Service, feature, or offering at any time. ITN reserves the right to refuse, suspend, or terminate service at its discretion, subject to applicable law.

  1. Customer Eligibility and Responsibilities

Customer represents that they are at least eighteen (18) years of age and legally authorized to enter into this Agreement.

Customer agrees to:

  • Provide accurate and complete account, billing, and service location information
  • Maintain compatible internet connectivity and internal network equipment
  • Secure all equipment, credentials, voicemail PINs, and access credentials
  • Notify ITN promptly of suspected fraud, misuse, or service issues
  • Comply with all applicable laws and regulations

Customer is responsible for all usage and charges, whether authorized or unauthorized, incurred on Customer’s account.

  1. Equipment

Unless otherwise stated in writing, all equipment provided by ITN remains the property of ITN. Customer is responsible for loss, theft, damage, or misuse beyond normal wear.

Upon termination of Service, Customer must return ITN equipment in good working condition. ITN may charge Customer for unreturned, damaged, or non-functional equipment.

  1. Changes to Services and Pricing

ITN reserves the right to modify, suspend, or discontinue any Services, features, pricing, or fees.

For commercial and business Customers, ITN may implement changes immediately and without prior notice, including changes driven by carrier, regulatory, or operational requirements.

For residential Customers, ITN will provide notice of material changes to pricing or fees as required by applicable law.

Continued use of the Services after the effective date of any change constitutes acceptance of the modified terms.

  1. Billing, Payments, and Fees

Services are billed in advance or arrears, on a recurring, non-recurring, usage-based, or other basis as specified by ITN or in Customer’s applicable service agreement, order form, invoice, or written notice. Customer agrees to pay all invoices by the due date listed.

ITN may assess fees and charges including, but not limited to:

  • Late payment fees
  • Returned payment (NSF) fees
  • Suspension, reconnection, or reactivation fees
  • Administrative, processing, or service change fees
  • Regulatory, compliance, or carrier-imposed fees
  • Usage-based, overage, installation, activation, or one-time charges

ITN bills electronically by default. Customer is responsible for reviewing invoices and promptly notifying ITN of any billing disputes. Failure to dispute charges prior to an account becoming past due may result in loss of dispute rights to the extent permitted by law.

No refunds or credits are issued for partial billing periods, unused services, or early termination, unless required by law or expressly agreed to in writing by ITN.

  1. Security Deposits and Credit Requirements

ITN may require a security deposit or advance payment based on credit history, payment behavior, service usage, or risk profile. Deposits may also be required to restore suspended services.

Security deposits may be applied to unpaid balances in the event of default and do not accrue interest unless required by law.

  1. Contracts, Renewals, and Termination

Some Services may be provided under a fixed contract term. Contract length, renewal terms, and early termination obligations are governed by these Terms and/or Customer’s executed agreement.

Unless otherwise stated, contracts automatically renew. Customer remains responsible for all charges incurred through the effective termination date, including any applicable early termination liability.

ITN may suspend or terminate Services without notice for non-payment, fraud, abuse, regulatory requirements, or violation of these Terms.

  1. Acceptable Use and Fraud

Customer agrees not to use the Services for unlawful, abusive, or fraudulent purposes, including robocalling, spoofing, harassment, toll fraud, or unauthorized international calling.

Customer is solely responsible for securing their network and equipment. ITN is not responsible for compromised systems or unauthorized usage. All resulting charges remain Customer’s responsibility.

  1. Taxes, Fees, and Regulatory Charges

Customer is responsible for all applicable federal, state, local, regulatory, and telecommunications-related taxes, fees, surcharges, and assessments, whether imposed now or in the future.

  1. Emergency Calling (E911)

VoIP 911/E911 service differs from traditional landline service. Customer must provide and maintain an accurate physical service address.

E911 service may be unavailable during power outages, internet outages, network congestion, or equipment failure. ITN strongly recommends maintaining an alternative means of contacting emergency services.

Customer acknowledges and accepts all limitations associated with VoIP emergency calling.

  1. Electronic Communications and Opt-In

By providing an email address, Customer consents to receive electronic communications from ITN, including billing notices, service communications, newsletters, updates, and marketing messages. Customer may opt out of marketing communications at any time. Service-related and billing communications may continue as required.

  1. Cancellation of Services

All cancellation requests must be submitted through ITN’s designated online cancellation portal unless otherwise expressly stated in Customer’s service agreement.

Customer remains responsible for all charges through the end of the billing period following completion of the cancellation process. Processing timelines may range from ten (10) business days up to ninety (90) days depending on the Service.

If Customer is under contract, ITN may deny cancellation or apply applicable early termination charges. Portal submission constitutes written notice where required.

  1. Warranty Disclaimer

All Services are provided “as is” and “as available.” ITN disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and uninterrupted service.

Customer’s sole and exclusive remedy for any Service interruption shall be a service credit, if any, as determined by ITN.

  1. Force Majeure

ITN is not liable for failure or delay due to events beyond its reasonable control, including natural disasters, power failures, carrier outages, labor disputes, or governmental actions.

  1. Third-Party Services

Certain Services rely on third-party providers. ITN is not responsible for the acts or omissions of such providers and does not guarantee their performance.

  1. Telephone Numbers

Telephone numbers are assigned subject to availability and regulatory requirements. ITN does not guarantee availability or portability. Customer must request porting prior to termination or risk loss of the number.

  1. SMS Communications

ITN may use SMS or text messaging to deliver service-related notifications, account updates, security alerts, promotional messages, or other communications related to the Services. Message frequency may vary. Message and data rates may apply based on Customer’s mobile carrier and plan.

By providing a mobile phone number to ITN, Customer consents to receive SMS communications from ITN. Customer may opt out of all SMS communications at any time by following the opt-out instructions included in the message or by contacting ITN. Upon opting out, ITN will cease sending SMS messages to the opted-out number, except where required by law.

Customer acknowledges that opting out of SMS communications may result in delayed receipt of time-sensitive or service-related information and agrees that ITN shall not be responsible for any impact resulting from such delay.

  1. Regulatory Compliance Indemnification

Customer agrees to indemnify and hold ITN harmless from claims, fines, penalties, or regulatory actions arising from Customer’s use of the Services, including FCC or TCPA violations.

  1. Limitation of Liability

To the fullest extent permitted by law, ITN shall not be liable for indirect, incidental, special, punitive, or consequential damages.

ITN’s total cumulative liability shall not exceed the total amount paid by Customer for the affected Service during the six (6) months preceding the event giving rise to the claim.

  1. Privacy

ITN collects, uses, and discloses information provided by Customer or generated through use of the Services for legitimate business, operational, billing, regulatory, and security purposes.

ITN does not sell Customer personal information. Information may be shared with third-party carriers, service providers, and vendors as necessary to provide the Services or comply with legal obligations.

  1. Collections

Past-due accounts may be referred to collections. Customer is responsible for all collection-related costs permitted by law, including attorney fees and court costs.

  1. No Unauthorized Resale

Customer may not resell, redistribute, sublicense, or make the Services available to any third party without ITN’s prior written consent. Unauthorized resale constitutes a material breach and may result in immediate termination and additional remedies.

  1. Third-Party Links and Tools Disclaimer

ITN’s websites or communications may provide access to third-party tools or websites. ITN does not control or endorse such tools and is not responsible for their content, availability, or performance. Use of third-party tools is at Customer’s own risk.

  1. User Submissions and Feedback

Customer grants ITN a non-exclusive, perpetual, irrevocable, royalty-free right to use any feedback, suggestions, or ideas provided by Customer without compensation or obligation.

  1. No Waiver

No failure or delay by ITN in exercising any right shall constitute a waiver. Any waiver must be in writing and signed by an authorized ITN representative.

  1. Attorney Fees and Costs

Customer agrees to reimburse ITN for reasonable attorney fees, court costs, and expenses incurred by ITN in enforcing these Terms.

  1. Survival

Provisions relating to billing, collections, limitation of liability, indemnification, and governing law survive termination.

  1. Class Action Waiver

Customer agrees disputes shall be brought on an individual basis and not as part of a class or representative action.

  1. Waiver of Jury Trial

The parties knowingly waive any right to a trial by jury.

  1. Venue and Jurisdiction

Any legal action shall be brought exclusively in state or federal courts located in Indiana.

  1. Optional Mediation

The parties agree to attempt good-faith mediation prior to litigation where appropriate.

  1. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

  1. Governing Law

These Terms are governed by the laws of the State of Indiana.

Website content is informational only and not binding. Customer agrees not to rely on website content and acknowledges that Services are governed solely by written agreements.

Section headings are for convenience only and do not affect interpretation.

  1. No Reliance on Statements

Customer has not relied on oral statements or marketing materials not expressly incorporated into this Agreement.

  1. Definitions

Capitalized terms may be defined in applicable service documents and are incorporated by reference.

  1. Entire Agreement

These Terms constitute the entire agreement between ITN and Customer regarding the Services.
